Terms and Conditions for Consumers

§ 1 Scope, Definitions
(1) These terms and conditions apply to all orders placed via the online store accessible at nicionlineshop.com (hereinafter referred to as “the online store”) between the operator of the online store (hereinafter referred to as “the seller”) and the customer (hereinafter referred to as “the customer”).
(2) A consumer within the meaning of these terms and conditions is any individual who enters into a legal transaction for purposes that are predominantly outside their trade, business, craft, or profession.

§ 2 Conclusion of Contract
(1) The product descriptions in the online store do not constitute binding offers but rather invitations to submit an offer.
(2) The customer can submit an offer via the online order form integrated into the online store. By clicking the button that concludes the order process, the customer submits a binding offer to purchase the goods in the shopping cart.
(3) The seller may accept the customer’s offer within five days by sending a written order confirmation or an order confirmation in text form (e.g., email), which results in the conclusion of the contract. If the seller does not accept the offer within this period, it is deemed rejected, and the customer is no longer bound to their offer.

§ 3 Prices and Payment Terms
(1) All prices stated on the seller’s website include the statutory value-added tax.
(2) Shipping costs are not included in the purchase price and will be displayed separately during the ordering process.
(3) The purchase price is due immediately upon conclusion of the contract. The payment methods available to the customer are displayed during the ordering process.

§ 4 Delivery, Shipping
(1) Delivery is made by shipping the goods to the delivery address provided by the customer.
(2) If the delivery of the goods fails for reasons for which the customer is responsible, the customer shall bear the reasonable costs incurred by the seller as a result.

§ 5 Retention of Title
The goods remain the property of the seller until full payment of the purchase price has been made.

§ 6 Liability for Defects (Warranty)
The statutory provisions on liability for defects apply.

§ 7 Applicable Law
(1) The law of the Federal Republic of Germany shall apply to all legal relationships between the parties, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) For consumers, this choice of law shall apply only insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.

§ 8 Dispute Resolution
The seller is not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
